Terms and Conditions

Scope

These General Terms and Conditions (GTC) of TwoMoons AG apply to all legal transactions made through the online store.
By placing an order, customers acknowledge these GTC as binding.

Language

The contractual language is exclusively German.
All contractual documents, GTCs, and further legally binding communication take place in German.
English translations are for information purposes only and are not legally binding.

Purchase Agreement

The items in our online store represent an offer. A purchase contract with the customer is validly concluded as soon as an order is placed with us and accepted by us. An order confirmation sent immediately after the order is not an acceptance of the offer, but merely a confirmation of the receipt of the order. TwoMoons reserves the right not to accept an order if product information or prices were incorrect.

Delivery

TwoMoons delivers exclusively to Switzerland and dispatches the goods through the Swiss Post.
The delivery takes place only after full payment has been received, both for stock items, which are dispatched within 2 days, and for non-stock items, for which delivery can take up to 2 weeks. Please note that all delivery times are non-binding.

Pre-order Delivery Guarantee

We do our best to fulfill all pre-orders. However, since we ourselves cannot guarantee the quantity of pre-orders from our suppliers, we unfortunately cannot extend this guarantee to our customers. If we do not receive enough products from our suppliers, we reserve the right to cancel your delivery or fulfill it only partially. The general principle is: "First Come, First Serve".
We will personally inform you via email if a pre-order cannot be fulfilled.
Pre-orders on our part are dispatched as quickly as possible. Since there can also be delays on the part of suppliers, we unfortunately cannot guarantee a delivery date.

Shipping Costs

For orders valued over 150 CHF, TwoMoons offers free standard shipping via B-Post (PostPac Economy). If the order value is less than 150 CHF, shipping costs via B-Post (PostPac Economy) are 7 CHF. For shipping via A-Post (PostPac Priority or A-Post Plus) with an order value over 150 CHF, the shipping cost is 4 CHF, while for orders under 150 CHF, the shipping cost is 9 CHF.
The exact shipping costs are clearly displayed at checkout.

Payment Terms

The payment period is 5 days from the date of the invoice.
If payment is not made within 7 days, the contract is automatically terminated.

Liability

TwoMoons assumes no liability for transport damages. After the goods are handed over to the Swiss Post, the liability lies with the customer.

Returns

Returns are accepted within 7 days of receipt, provided the items are in their original packaging, unused, in perfect condition, complete, and undamaged.
The receipt must be included with the return.

Warranty

TwoMoons provides no guarantee for the sold products or services. Only the statutory warranty rights apply.

Data Protection

TwoMoons uses advanced encryption technologies to ensure the security of personal information. Your data will be used exclusively in accordance with TwoMoons's privacy policy, which can be viewed through a relevant link .

Severability Clause

If it turns out that a provision of these General Terms and Conditions is unlawful, void or unenforceable, this provision is still enforceable to the extent permitted by law, and the unenforceable part is considered as separated from these General Terms and Conditions, without affecting the validity and enforceability of the remaining provisions.

Updating the GTC

You can always view the latest GTC here. TwoMoons may change these GTC at any time and will publish such changes on the website. Please regularly check for updates. If you continue to use the website after such updates, you accept the new GTC.

Governing Law

For all legal relationships and disputes arising from or in connection with transactions between TwoMoons and customers, the jurisdiction at the seat of TwoMoons AG is exclusively competent. Swiss law exclusively applies.
